Sellers stop using “PM please”, you can be fined RM50,000

E-commerce in Malaysia is experiencing a boom and it the progress is accelerated even more during this pandemic.

Throughout your online shopping experience, I’m sure that you’ve come across some sellers who do not disclose their selling price in the post that they’ve make. They prefer interested buyers to private message (PM) them for further enquiry.

Even though this practice is widely used in E-commerce, but do you know that this practice is actually illegal in Malaysia? You can be fined up to RM50,000 and jailed for doing this.

This matter had been brought up to discussion by the officials 4 years ago and to protect the rights of consumers, Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) had taken action against sellers who do not give sufficient information about the product that they sell.

According to Harian Metro, organisations can be fined for up to RM100,000, whereas individuals can be fined for up to RM50,000 or jailed for not more than 3 years, or even both. It is stated in the Section 145 of Consumer Protection Act 1999.

Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) wanted to make it clear to the public so that the incident does not happen again. These are the 8 information that a seller must provide to the consumers to avoid being charged under the act.

  • Registered name of business
  • Company or business registered number
  • Product specifications
  • Terms and conditions
  • Price of the stated product or service
  • Contact details, i.e. e-mail, phone number
  • Payment method
  • Estimated time for delivery

As a reminder to all sellers, please refrain from asking interested buyers to use “PM please”. Stating the details down and being transparent helps you gain consumer confidence too.
