Last Monday (9 August), a senior citizen in Lenggong, Negeri Sembilan was being arrested after Kedah Menteri Besar (MB), Muhammad Sanusi Md Nor’s media officer filed a complaint against him for the remark he made over the Facebook live session.
It turns out that the 61 year-old retiree was a former armed forces member and he is currently soughing to take legal action against the Kuala Muda district police chief ACP Adzli Abu Shah for slandering him.
The senior citizen was arrested at his home at about 4 a.m. during the dawn of 9 August and he was being brought across state borders to Kuala Muda, Kedah for questioning.
According to FMT, the senior citizen was identified as Roslei Kamisan and he is not seeking a RM100,000 in damages and a public apology from Adzli for labelling him as having a “prior record” for “criminal intimidation”.
In addition, he wanted Adzli to retract his alleged defamatory statement unconditionally.
“That statement (by Adzli) was false and defamatory towards our client. Our client does not have any court charges or any ongoing investigations against him under Section 506 of the Penal Code.” Roslei’s lawyer, Ali Sethi Alvi said, as reported by Malaysiakini.
“This defamatory statement has tarnished the good name of our client as a retired member of the Armed Forces, a Muslim, and an individual respected and liked by many.”
Meanwhile, FMT reported that the senior citizen is currently represented by his lawyers, Asheeq, Ramkarpal Singh, and Sangeet Kaur Deo, believes that the police had released the statement with ill-intention, knowing that the statement will be read by the public and cause irreversibly damage his reputation.
“This has led to the perception that my client is a criminal and as one who does not obey the law. It also gives the impression that there is a tendency to criminally intimidate others and that he is a bad person.” Ramkarpal said.
With this, Roslei has sent Adzli a letter of demand and he has 14 days to respond to it. If Adzli fails to comply with his demands, Roslei’s legal team will initiate legal action against him.
“Should Adzli fail to fulfil these demands within 14 days from when he received this letter, we (the lawyers) have been instructed to file legal proceedings against Adzli in court.” Asheeq said.
He added that the letter of demand was send on Friday (13 August).
