Following the legal suit which her physical education (PE) teacher initiated, student Ain Husniza said that she will be counter suing her PE teacher for RM5 million.
According to The Star, her lawyer, Datuk Sankara Nair had advised her that they have a case for a counter suit, following the letter of demand from the PE teacher.
“I have responded by letter that we are suing you for RM5mil for inflicting intentional emotional distress.”
“I have issued a letter to their lawyer on this.” he told reporters from The Star at the Sungai Buloh police headquarters on Friday (6 August).
Sangkara added the action was a form of civil action under the Civil Law 1956 (Act 67) after Ain faced depression in the context of intentionally triggering emotional stress (IIED), following the case which was considered as sexual harassment.
This comes after Ain took it to social media to share that she was being called in to the police headquarters on Friday (6 August) evening to have her statement recorded.
Previously, Ain had been reported to have receive a letter of demand from her PE teacher, seeking for damages of RM1 million for the alleged defamatory remarks she made.
Ain also shared that she have 7 days to fulfil the 5 demands, one of which was to pay RM1mil for punitive damages.
Nonetheless, she did not elaborate on the other demands, nor what the purported “defamatory statements” were.
Earlier this year, Ain Husniza had made it to the headlines after calling out her PE teacher for making rape jokes in class. Following which, she started the #MakeSchoolASaferPlace in the country.
In a Facebook post, her father, Saiful Nizam added that the letter was delivered to them at 2 p.m. from a law firm of Rasshidi Ema & Yung and the letter stated 5 demands, including to pay RM1 million in damages.
He also noted that the letter came from the physical education teacher at the school his daughter previously studied.
