After the legal threat from her physical education (PE) teacher demanding RM1 million damages from her, Ain Husniza, the 17 year-old secondary school student who is behind the #MakeSchoolASaferPlace movement, said she was being called in to provide a police statement for a report lodged by the teacher she previously accused of making a rape joke in class.

Ain took the incident to Twitter and said “Tomorrow, I will be going to IPD Sungai Buloh at 5pm with my father because of a report being made by the alleged teacher. Wish me luck lol.”

Meanwhile, her father, Saiful Nizam in a separate Tweet said that they will be going in accompanied by lawyer Datuk Sankara Nair, as well as Petaling MP Maria Chin Abdullah and Seputeh MP Teresa Kok.

Earlier on, MalaysiaKini reported that the police said that there will be no action taken against the PE teacher who allegedly made rape jokes in class.

According to Sungai Buloh, OCPD Supt Shafa’aton Abu Bakar, he said that the police received a “No Further Action” notice from the deputy public prosecutor on the case yesterday (5 August).

“Although what he said did not take into account the sensitivity of the female students present (in the class), but what he said was not strong enough (criminal) elements to prosecute in court.”

“The investigating officer is investigating the case in accordance with several laws, including Sections 11, 12 and 15 of Sexual Offenses against Children (SOACA) and also in accordance with Sections 509 and 294 of the Penal Code.” a senior police officer said.

On the other hand, it was reported that 17 other witnesses who were called in to give their statements, where all of them gave a slightly different versions of what happened at the scene.

“According to the witness, although the teacher did talk about the rape of people aged 18 and above, (he also reminded) ‘if you rape, you will be jailed and caned’. This was not mentioned (in the social media post).”

“Besides this female student (Ain), there are two or three other students who agree with her and it feels like sexual harassment.”

“But 17 other students have nothing wrong with what the teacher said.” a source said to MalaysiaKini.

Meanwhile, he said that the authorities also took into account that the statement made by the PE teacher during a learning session regarding sexual harassment in the classroom.

At the same time, he added that the authorities had investigated the subject matter that was taught in the class.

He also agreed that the PE teacher could have used better and less sensitive words when conveying the matter to his students.

“He has been teaching for 21 years, he should convey (sensitive topics) better.” he added.
